The Sole Representative visa

With Brexit, there has been an increase in applications for the Sole Representative visa, which allows foreign companies to open branches in the United Kingdom. This popular visa type will be discussed in-depth in this article.

With the Sole Representative visa, you can obtain a UK residence permit for an employee of your company in order to open a branch of your business in the UK. As a result, the representative employee and his family will be able to live in the UK to establish this branch.

If you hold a senior position in the company and own less than 50% of the company’s shares, you can apply to be a representative.

This visa will allow you to:

  • Work full-time in your newly established UK-based branch.
  • Bring your family (your dependents) to the UK.
  • Initially obtain a 3-year visa, then apply to extend it at the end of the three years.
  • Apply for permanent residence in the UK after 5 years

However, with this visa;

  • You cannot work for yourself or any other business
  • You cannot receive public funds until you become a permanent resident

The information and documents required for the application can be summarised as follows;

  • Description of the business operations of the branch establishment, including information on assets and accounts,
  • Description of the position, employment contract and salary information,
  • Letter confirming that the applicant is familiar with the position and has authority to make operational decisions,
  • Proof that he is directly employed by the company and is not acting as a sales representative

In addition to these, a business plan with the job description and financial evaluation of the branch to be established must be submitted. You may need to prove your knowledge of the English language with at least CEFR level A1 in speaking and listening, however,  you may be able to meet the English language requirement in other ways.

You should get a decision on your visa within 3 weeks when you apply from outside the UK. If you apply from inside the UK, you will get a decision within 8 weeks.
